I'm wanting to start my own cake decorating business. Right now I'm going to have to start in my own home in my small kitchen. How do I go about making things legal? Thanks.

There won't be any legal issues for you. You might want to call the City Treasurer and ask if you need a license or if you have to pay any city tax(you won't but they appreciate the call in case someone calls them to ask about you- they will already know). You won't have any employees in the beginning. That makes life easy.
Call a reporter for the local newspaper and ask if she will interview you. The Saturday paper is a slow news day. If that works offer to appear on the tv station morning show at 6am. Bring some cakes..

Can I create a small business with the same name that someone else uses in my state?

I just opened a small photography business in Tennessee, and i created a website for it using yahoo small business. I did some research today and found out that there is already a photography business using this name in the same state, but not the same city or near here. Is that okay or do I have to change it?
